AN ORDINANCE relating to regulatory business and professional license fees; adjusting business and professional license fees associated with the regulated activities of public parking lots and garages, used goods, adult entertainment, and marijuana; and amending Seattle Municipal Code Sections 6.48.020, 6.204.080, 6.270.060, and 6.500.080.

WHEREAS, The City of Seattle (“City”) is authorized under RCW 35.22.280 to grant licenses for any lawful purpose, and to fix by ordinance the amount to be paid therefor; and

WHEREAS, the City periodically reviews its license and registration fees to determine whether existing licenses and registrations appropriately reflect the regulated activities, whether fee revenues are covering the cost of providing the regulatory service, and whether those license fees designated as revenue-producing fees are set appropriately, among other reasons; and

WHEREAS, the City has acquired a technology system required to manage regulatory compliance and consumer protection licensing and enforcement activities; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Section 6.48.020 of the Seattle Municipal Code, last amended by Ordinance 122192, is amended as follows:

6.48.020 License required-Fee ((.))

It is unlawful for any person to own, operate, or maintain a public garage or parking lot without first having obtained a license to do so.

A.                     The fee for such license is hereby fixed at the rate of ((Six Dollars ($6))) $10.25 per year for each ((one thousand (1,000))) 1,000 square feet of floor or ground space contained in such parking garage or parking lot and used for parking or storage purposes; and

B.                     The Director shall review annually the licensing fee in this Section 6.48.020 and may make any necessary adjustments in a Director’s Rule to ensure the fee achieves full cost recovery of the Department’s administrative, enforcement, and other regulatory costs based on, but not limited to consideration of the following factors:

1.                     The projected costs and annual budget allotted for administrative, enforcement, and regulatory costs across the parking garage and parking lot industry; and

2.                     The need for increased enforcement to reduce illegal activity.

Section 2. Section 6.204.080 of the Seattle Municipal Code, last amended by Ordinance 125449, is amended as follows:

6.204.080 Used goods

The annual fee for a used goods license shall be:

A.                     Used goods dealer: (($137)) $208; and

B.                     The Director shall review annually the licensing fee in this Section 6.204.080 and may make any necessary adjustments in a Director’s Rule to ensure the fee achieves full cost recovery of the Department’s administrative, enforcement, and other regulatory costs based on, but not limited to consideration of the following factors:

1.                     The projected costs and annual budget allotted for administrative, enforcement, and regulatory costs across the used goods industry; and

2.                     The need for increased enforcement to reduce illegal activity.

Section 3. Section 6.270.060 of the Seattle Municipal Code, last amended by Ordinance 125449, is amended as follows:

6.270.060 License fees.

The license year for all fees required under this Chapter 6.270 shall be from January 1 to December 31. All license fees shall be payable on an annual basis, which fees shall be as follows:

A.                     Adult entertainment premises license: (($755)) $905 per year;

B.                     Adult entertainer’s license: (($150)) $170 per year;

C.                     Adult entertainment manager’s license: (($152)) $216 per year; and

D.                     The Director shall review annually the licensing fees in this Section 6.270.060 and may make any necessary adjustments in a Director’s Rule to ensure the fees achieve full cost recovery of the Department’s administrative, enforcement, and other regulatory costs based on, but not limited to consideration of the following factors:

1.                     The projected costs and annual budget allotted for administrative, enforcement, and regulatory costs across the adult entertainment industry; and

2.                     The need for increased enforcement to reduce illegal activity.

Section 4. Section 6.500.080 of the Seattle Municipal Code, last amended by Ordinance 125516, is amended as follows:

6.500.080 License and related fees

A.                     Licenses shall expire June 30 each year and be annually renewable. The following annual fees shall apply:

1.                     Marijuana License - Located in Seattle                     (($1,500)) $3,500

2.                     Marijuana License - Located outside Seattle                     (($750)) $2,000

B.                     License fees are non-refundable.

C.                     License fees are not prorated.

D.                     Related fees

1.                     Premises ((Reinspection)) reinspection                     $250

2.                     License ((Reinstatement)) reinstatement                     $250

3.                     Relocation of ((Physical Address)) physical address                     $250

E.                     The Director shall review annually the licensing fees in this Section 6.500.080 and may make any necessary adjustments in a Director’s Rule to ensure the fees achieve full cost recovery of the Department’s administrative, enforcement, and other regulatory costs based on, but not limited to consideration of the following factors:

1.                     The projected costs and annual budget allotted for administrative, enforcement, and regulatory costs across the marijuana industry; and

2.                     The need for increased enforcement to reduce illegal activity.

Section 5. Sections 1 through 4 of this ordinance shall take effect January 1, 2019.

Section 6. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
