AN ORDINANCE authorizing the Superintendent of Parks and Recreation to execute and accept from the Washington State Department of Natural Resources, on behalf of The City of Seattle, a waterway permit for Waterway 1 in Laurelhurst.

WHEREAS, the Laurelhurst Community Club has been managing Waterway 1 as public open space and water access for over a decade; and
WHEREAS, Laurelhurst Community Club originally held a waterway permit from the Washington State Department of Natural Resources (DNR) for the improvement and stewardship of the waterway; and
WHEREAS, when the community went to renew the permit, DNR had new requirements that made it too onerous for the community; and
WHEREAS, Seattle Parks and Recreation (DPR) agrees to be the permit holder while Laurelhurst Community Club remains the steward of Waterway 1; and
WHEREAS, Laurelhurst Community Club maintains Waterway 1 through a Memorandum of Agreement with DPR; and
WHEREAS, the waterway permit for Waterway 1 has expired, and DPR and DNR have negotiated a new waterway permit for the City's use of Waterway 1 property; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation ("Superintendent") or the Superintendent's designee is hereby authorized on behalf of The City of Seattle ("City") to execute a waterway use agreement ("Permit") substantially in the form of Attachment 1 and identified as "Waterway 1 Permit" with the Washington State Department of Natural Resources, authorizing the City to use the property as a public park providing recreational and educational opportunities for all residents and visitors to the region.
Section 2. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle M...
