AN ORDINANCE relating to the Seattle Department of Transportation’s Next Generation Intelligent Transportation System; authorizing the Director of the Department of Transportation to acquire, accept, and record, on behalf of The City of Seattle, a deed for street purposes for a portion of Block A, City Gardens, from Rainier TT LLC, a Washington limited liability company; laying off, opening, widening, extending, establishing, and designating the property for street purposes; placing the real property conveyed by such deed under the jurisdiction of the Department of Transportation; and ratifying and confirming certain prior acts.

WHEREAS, the next several years will be a period of intense construction activity in downtown Seattle due to the viaduct replacement, seawall replacement, and waterfront improvement projects; and
WHEREAS, to address these challenges and upgrade aging systems, the City has appropriated funds in the 2016-2021 Adopted Capital Improvement Program for the Next Generation Intelligent Transportation Systems project (“ITS Project”); and
WHEREAS, the ITS Project utilizes electronic and communication technologies such as: sensors, cameras, and electronic signs; to increase effectiveness, efficiency, and safety for all modes of transportation; and
WHEREAS, the ITS Project will design and implement upgrades to the City’s Traffic Management Center; implement expansion of real-time information to support major construction projects; deploy Dynamic Messaging Signs (“Signs”) at key decision points to provide real-time information such as incidents, travel times, bridge opening notices, planned construction, and event information; and install dynamic signal timing (self-adjusting traffic signal timing based on traffic volume on key corridors around the major construction projects); and
WHEREAS, installation of one of the Signs requires that the City acquire permanent property rights to install and maintain the sign; and
WHEREAS, it is therefore necessary for the City to obtain Council approval to acquire, accept, and record the property acquisition necessary to complete the ITS Project; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Deed for Street Purposes from RAINIER TT LLC, a Washington limited liability company, dated September 16, 2015, and recorded under King County Recording Number 20151007001258, which is attached as Attachment A and incorporated into this ordinance, is accepted for street purposes, placed under the jurisdiction of the Department of Transportation, and laid off, opened, widened, extended, and established as street right-of-way.
Section 2. Any act consistent with this ordinance taken prior to its effective date is hereby ratified and confirmed.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
