AN ORDINANCE relating to the Seattle Public Utilities' Arbor Heights Fire Flow Improvements project; accepting an easement for water and sewer purposes over, under, through, across, along and upon property commonly known as 3707 SW 105th Street, King County Assessor Parcel number 022303-9302; and ratifying and confirming certain prior acts.

WHEREAS, Seattle Public Utilities' Arbor Heights Fire Flow Improvements Project replaced a  2-inch water main with an 8-inch water main to increase and assure water flow for fire suppression; and
WHEREAS, the City of Seattle subsequently discovered it has no property rights where part of the water main crosses property commonly known as 3707 SW 105th Street, King County Assessor Parcel number 022303-9302; and
WHEREAS, the City of Seattle required a recorded easement across said parcel for water and sewer purposes prior to construction; and
WHEREAS, owner of said parcel, Jeanne A. Hedington, donated and granted the needed easement; and
WHEREAS, to keep the project on schedule it was necessary to record the easement document prior to having the easement accepted by a City of Seattle ordinance; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1.  The City of Seattle hereby accepts the easement attached as Attachment 1 hereto and recorded under King County recording number 20120627001488, granted to the City  by Jeanne A. Hedington, for water and sewer purposes over, under, through, across, along and upon the property commonly known as 3707 SW 105th Street, King County Assessor Parcel number 022303-9302, and legally described as follows:
The North 30 feet of the West 65 feet of the East 120.46 feet of the South one-half (1/2) of the Northwest one-quarter (1/4) of the Northeast one-quarter (1/4) of the Southeast one-quarter (1/4) of Section Two (2), Township Twenty-Three (23), North, Range Three East, W. M.; except the South 184 feet thereof, situated in the County of King, State of Washington.
 
Section 2.  Any act consistent with the authority of this ordinance taken prior to its effective date is hereby ratified and confirmed.
 
 
Section 3.  This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
