WHEREAS, The City of Seattle is continually acquiring property to expand existing parks and conserve green spaces; and

WHEREAS, The City of Seattle does not have adequate funding to acquire all the properties worthy of conservation; and

WHEREAS, Julia Lee Park (Park), built on private property located at 2701 East Harrison Street, was established on the southwest corner of East Harrison and Martin Luther King Jr. Way in 1993 as a memorial to Julia Lee Roderick Knudsen, by her husband C. Calvert Knudsen (Donation Property); and

WHEREAS, the Park holds an Italianate garden with handsome wooden benches and has become a green and peaceful meeting place for Madison Valley residents of all ages; and

WHEREAS, the Knudsen Family and the Seattle Department of Parks and Recreation (DPR) have agreed on new plantings for the Park, to be planted in the fall of 2016, that have the same character and density of removed plants, taking into consideration cost, sustainable upkeep, and maintenance; and

WHEREAS, the Knudsen family, by and through the Madison Valley Park Foundation, would like to donate the Donation Property to The City of Seattle (City) upon the condition that the Donation Property continue as a future public park, retain the name of “Julia Lee Park” and keep its current park character; and

WHEREAS, DPR anticipates that any future changes to the Donation Property will be consistent with the current architectural and landscape design of Julia Lee Park including the prominent trees, open plaza, and arboretum character of the park; and

WHEREAS, DPR believes that any Seattle-Perugia Sister City recognition in the plaza area of the Donation Property will be of a size, scale, and design that reflects the current design of the Park.  DPR shall retain final approval of any recognition within the Donation Property, but intends on seeking consultation with the Knudsen family in respect for the donation of the Donation Property to the City; and

WHEREAS, it is intent of both SPR and the Knudson family for the City to take title, ownership, and all rights and interests to the Donation Property free and clear of unnecessary encumbrances; and

WHEREAS, the Seattle City Charter requires that all acquisition and disposition of real property  rights be authorized and accepted by or under authority of City ordinance; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The Superintendent of Seattle Parks and Recreation (“Superintendent”), or Superintendent’s designee, is authorized, on behalf of The City of Seattle, to acquire by donation from the Madison Valley Park Foundation the following real property legally described below (“Donation Property”):

Real property in the County of King, State of Washington, described as follows:

ALL OF LOTS 23, 24, 25 AND 26, BLOCK 13 OF MADISON STREET ADDITION TO THE CITY OF SEATTLE, ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUME 2 OF PLATS, PAGE 85, IN KING COUNTY, WASHINGTON.

EXCEPT FOR THE FOLLOWING DESCRIBED PARCEL: THAT PORTION OF LOTS 23, 24 AND 25, BLOCK 13 OF SAID PLAT OF MADISON STREET ADDITION DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF LOT 23; THENCE SOUTH 89° 48' 30" EAST ALONG THE SOUTH LINE OF LOT 23 FOR 5.00 FEET; THENCE NORTH 00° 01' 40" WEST PARALLEL WITH THE WEST LINE OF LOT 23 FOR 11.80 FEET; THENCE NORTH 39° 39' 21" EAST FOR 5.75 FEET; THENCE NORTH 00° 15' 40" WEST FOR 20.52 FEET; THENCE SOUTH 89° 44' 20" WEST FOR 3.59 FEET; THENCE NORTH 00° 01' 40" WEST FOR 33.04 FEET;

THENCE NORTH 44° 04' 42" WEST FOR 7.19 FEET TO THE WEST LINE OF SAID LOT 25; THENCE SOUTH 00° 01' 40" EAST ALONG THE WEST LINES OF LOTS 25, 24 AND 23 FOR 74.92 FEET TO THE SOUTHWEST CORNER OF LOT 23 AND THE POINT OF BEGINNING TOGETHER WITH THAT PORTION OF LOT 1 BLOCK 13 OF SAID PLAT OF MADISON STREET ADD. DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EAST LINE OF SAID LOT 1 THAT IS 12.23 FEET SOUTH OF THE MOST NORTHERLY CORNER OF SAID LOT 1; THENCE NORTH 00° 01' 40" WEST FOR 12.23 FEET TO THE NORTHERLY CORNER OF LOT 1; THENCE SOUTH 44° 40' 07" WEST ALONG THE EASTERLY MARGIN OF EAST ARTHUR PLACE FOR 8.50 FEET; THENCE SOUTH 44° 04' 42" EAST FOR 8.60 FEET TO THE POINT OF BEGINNING (CONTAINING 10,915 SQ. FT.)

                     Section 2. The Superintendent, or the Superintendent’s designee, is authorized to execute such documents as the Superintendent or designee deems necessary or desirable to accomplish the acquisition consistent with this ordinance, and to accept the deed for the Donation Property by attaching to the deed the Superintendent’s written acceptance thereof, and recording the same. 

                     Section 3. The Donation Property shall be accepted by the City for open space, park, and recreation purposes, and placed under the jurisdiction of the Seattle Department of Parks and Recreation with the name of Julia Lee Park.

 

Section 4. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
