AN ORDINANCE relating to the Department of Parks and Recreation; authorizing the Superintendent of Parks and Recreation to enter into a Project Partnership Agreement with the Seattle District United States Army Corps of Engineers for purposes of executing the Alki Coastal Erosion Control Project; and ratifying and confirming certain prior acts.

WHEREAS, the Department of Parks and Recreation (DPR) owns and maintains the Emma Schmitz Memorial Overlook Park, located at 4503 Beach Drive SW; and
WHEREAS, the park contains a seawall built circa 1927, approximately 400 feet long, comprised of 10-foot-tall concrete slabs embedded in large concrete footings, and held in position by a series of recycled streetcar rails; and
WHEREAS, the existing seawall provides vital protection for a 54-inch diameter King County Metro sewer line, which is embedded about 2 feet behind the seawall, as well as Beach Drive SW and other City-owned infrastructure, from tidal and storm damage; and
WHEREAS, the existing seawall is badly deteriorated and in danger of collapse in the event of severe storm or tidal activity; and
WHEREAS, the U.S. Army Corps of Engineers (USACE), Seattle District, has partnered with DPR to design and implement a coastal storm damage reduction project under Section 103 of the Rivers and Harbors Act of 1962, as amended; and
WHEREAS, USACE has assessed the seawall’s condition and proposed its replacement in its Alki Coastal Erosion Control Project Detailed Project Report/Environmental Assessment, which was approved by USACE’s Northwestern Division on August 26, 2016; and
WHEREAS, USACE has projected a total cost of $2,841,000 to design and build a replacement seawall; and
WHEREAS, USACE now proposes a Project Partnership Agreement (PPA) with The City of Seattle that would entail a cost-sharing agreement of 65 percent federal (USACE), 35 percent non-federal sponsor (DPR) for implementation of the full project, and the non-federal sponsor’s cost share can be remitted through a combination of cash payment and in-kind services; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation (“Superintendent”), or the Superintendent’s designee, is authorized to execute for and on behalf of The City of Seattle a Project Partnership Agreement (PPA) that will implement design and construction of a new seawall at Emma Schmitz Memorial Overlook Park as fully described in the U.S. Army Corps of Engineers’ Alki Coastal Erosion Control Project Detailed Project Report/Environmental Assessment. The Superintendent is further authorized to make such minor revisions to the stipulations contained in the PPA, and any necessary or convenient amendments to the PPA, including monetary revisions based on actual construction costs, as the Superintendent deems to be in the best interest of the City, and consistent with the purposes of this ordinance.
Section 2. Any act consistent with the authority of this ordinance taken after its
passage and prior to its effective date is ratified and confirmed.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
